The Standard Traffic Ordinance as adopted is hereby modified by adding thereto the following:

The governing body may, by resolution, establish and fix the location of such traffic control devices as may be deemed necessary to guide and warn traffic under the provisions of this chapter, other traffic ordinances and the state laws. The city shall place and maintain such traffic control signs, signals and devices when and as may be required by the authority of the governing body to make effective the provisions of this chapter and other ordinances for the regulation of traffic.

(a)   Sec. 33. Speed Limits on all residential streets shall be as established in the Standard Traffic Ordinance, except:

(1)   Lexington Avenue shall have a maximum speed limit of 35 miles per hour from 95th Street to 83rd and 45 miles per hour from Sunflower Road to 95th Street.

(2)   West 83rd Street shall have maximum speed limits of 20 miles per hour from Delaware to Ottawa Streets, 30 miles per hour on the sections from Kaw to Delaware Streets and Ottawa to Penner Streets, 35 miles per hour from Kaw to Waverly Streets, and 45 miles per hour from Waverly Road to eastern City boundary.

(3)   Ferry Road, Hadley Road and Kaw Avenue shall have a maximum speed limit of 20 miles per hour.

(4)   91st Street, between Sunflower Road and Lexington Avenue, shall have a maximum speed limit of 30 miles per hour except that said maximum speed shall be reduced to 20 miles per hour for the times designated as school zone hours. The school zone hours shall be 7:00 am to 9:00 am, and 2:30 pm to 4:30 pm on days when school is in session.

(5)   87th Street, between Penner Avenue and Sunflower Road, shall have a maximum speed limit of 25 miles per hour.

(6)   103rd Street, from Evening Star Road to Sunflower Road, shall have a maximum speed limit of 45 miles per hour.

(7)   Astra Parkway (within the corporate boundaries of the city) shall have a maximum speed limit of 35 miles per hour.

(8)   The following stretches of residential streets located in and around the DeMeadows Subdivision shall have a fixed maximum speed limit of 25 miles per hour:

(A)  The existing 87th Street in DeMeadows Subdivision;

(B)  The existing 87th Terrace in DeMeadows Subdivision;

(C)  The existing 88th Terrace in DeMeadows Subdivision;

(D)  The existing 89th Street in DeMeadows Subdivision;

(E)   The existing 88th Street in the West Meadows Subdivision;

(F)   Valleyview Street from Golden Lane to Commerce Drive; and

(G)  Golden Lane in the DeMeadows Subdivision.

(b)   Modification of Sections Adopted. The following additions are made to the Standard Traffic Ordinance for Kansas Cities adopted by the City:

(1)   The following subsection shall be in addition to Section 44 of the Standard Traffic Ordinance:

“(c) No driver shall, at any time, cross over any pavement striping designed to mark a no-passing zone throughout its length for the purpose of making a turn, parking on the opposite side of the street, or crossing the opposite lane of traffic.”

(2)   The following subsection shall be in addition to Section 37 of the Standard Traffic Ordinance for Kansas Cities adopted herein:

“(b) Exhibition of speed or acceleration is defined to include, but is not limited to, those acts which cause or create unnecessary rapid acceleration, unnecessary tire squeal, skid, smoke, or slide upon acceleration or stopping including the casting of tread, gravel, dirt or other road surface materials from the tires; acts that simulate a temporary race; acts that cause the vehicle to unnecessarily turn abruptly, sway or lose traction with the road surface.”

(a)   When signs are erected giving notice thereof, no person shall operate any truck with a gross weight in excess of the amounts specified herein at any time upon any of the following streets, bridges, or parts of streets or bridges within the city:

(1)   20,000 pound limit.

Wea Street

Peoria Street

Wyandotte Street from 83rd Street to 84th Street

Osage Street from 83rd Street to 84th Street

Jaycee Street

(2)   53,999 pound limit.

Ottawa Street from 79th Street to 83rd Street

89th Street from and between the intersection of Waverly Road and Kill Creek Road.

(3)   Wyandotte Bridge [a/k/a Bridge SH-64 or NBI Bridge #000000000460240].

       Any truck exceeding the following limits is prohibited: (a) Truck Type 3 = 22 Tons; (b) Truck Type 3S2 = 31 Tons; and Truck Type 3-3 = 44 Tons.

(b)   Exceptions. Exceptions to this shall apply only for necessary ingress and egress for residents on the specific area of restriction and except for deliveries by truck as defined herein to a place of business and/or residence which exists on the area of restriction. All other truck travel along the area of restriction is strictly prohibited.

(c)   Determination of Gross Weight. For purposes of this article, gross weight shall mean the greater of the weight for which the vehicle is licensed pursuant to K.S.A. 8-143(2) and the actual gross weight of the vehicle. Law enforcement officers are authorized under this article to weigh any truck at any grain elevator in the city and within five miles of the point of alleged violation at the expense of the city. It shall be a violation of this article for any owner or driver of such vehicle to refuse when directed by a law enforcement officer to drive to an available weighing facility as directed by such law enforcement officer.

(a)   Area of Restriction: There shall be a daily prohibition against the operation of any truck upon Waverly Road from and between the intersection of 83rd Street and Explorers Trail in the city.

(b)   Daily Prohibition Defined: Daily prohibition as used in this article shall mean that the prohibition shall apply equally to all days of the week.

(c)   Truck Defined: A truck for purposes of this article shall include all motor vehicles or combination of vehicles which are included within those vehicles required by the Kansas Secretary of Transportation to be plated, licensed and tagged as a truck and which have a gross registered vehicle weight equal to or greater than 53,999 pounds. Further, this restriction shall apply to all trucks traveling on the area of restriction except only for necessary ingress and egress for residents on the specific area of restriction and except for deliveries by a truck defined herein to place of business and/or residence which exists on the area of restriction. All other truck travel along the area of restriction is strictly prohibited.

In accordance with K.S.A. 8-2002, the governing body does hereby prohibit parking on the north side of the street on that certain street known as 88th Street in that certain subdivision known as west Meadows from the intersection of 88th Street and Commerce Drive to the intersection of 88th Street and Golden Lane.

(a)   It shall be unlawful for any vehicle owner, property owner, resident or tenant to allow a vehicle to be parked or stored outside of a building on any surface other than an area designated as a driveway or a parking area. A designated driveway or parking area shall be paved or, if not paved, at a minimum shall consist of four (4) inches of compacted gravel base. Nothing herein shall be construed as a waiver of, or otherwise affect, the City’s Zoning Regulations or surfacing standards for new construction.

(b)   Exceptions. This section shall not apply to agricultural equipment parked on property used primarily for agricultural purposes; to recreational vehicles, boats or hauling trailers parked in compliance with the provisions of this Code; or to temporary events where parking on unpaved surfaces or areas not designated as a driveway or parking area: (1) is for a duration of no more than 48 hours; or (2) has been specifically approved by the City.

(c)   Penalty. The city may file a complaint in the municipal court of the city against any person violating this section and, upon conviction of any violation of the provisions of this section, such person may be fined in an amount not to exceed $100 or be imprisoned not to exceed 30 days or be both fined and imprisoned. Each day during or on which a violation occurs or continues after notice has been served shall constitute an additional or separate offense.

Parking is prohibited on the south side of 91st Street, beginning at the southwest corner of the northeast quarter of section 32, township 12S, Range 22E and continuing east 700 feet along 91st street.

In accordance with K.S.A. 8-2002, the Governing Body does hereby prohibit parking on the east side of Wea Street as set forth below:

(a)   Parking shall be restricted from a point 130 feet south of the center of the intersection of 84th Street and Wea Street to a point 155 feet south of the center of said intersection.

(b)   Parking shall be restricted from a point 200 feet south of the center of the intersection of 84th Street and Wea Street to a point 225 feet south of the center of said intersection.

(c)   Parking shall be restricted from a point 270 feet south of the center of the intersection of 84th Street and Wea Street to a point 295 feet south of the center of said intersection.

(d)   Parking shall be restricted from a point 465 feet north of the center of the intersection of Lexington Avenue and Wea Street to a point 440 feet north of the center of said intersection.

(e)   Parking shall be restricted from a point 250 feet north of the center of the intersection of Lexington Avenue and Wea Street to the center of said intersection.

In accordance with K.S.A. 8-2002, the Governing Body does hereby prohibit all parking on the north and south sides of 82nd Street, beginning 55 from the western right of way line of Sunset Drive at 82nd Street and ending at the western terminus of 82nd Street, where the City has installed a gate.

In accordance with K.S.A. 8-2002, the Governing Body does hereby prohibit parking along the aforementioned streets as more precisely described as follows:

(a)   The south side of 83rd Street from Penner Avenue to Center Street.

(b)   The south side of 87th Circle from Golden Lane, east to the terminus of 87th Circle.

(c)   The south side of 87th Terrace from Golden Lane to Thompson Drive.

(d)   The north side of 88th Street from Commerce Lane to Golden Avenue.

(e)   The south side of 88th Terrace from Golden Lane to Thompson Drive.

(f)   The south side of 89th Street from Golden Lane to Thompson Drive.

(g)   The east side of Golden Lane from Valley View Street to 89th Street

(h)   The west side of Thompson Drive from 87th Terrace to 89th Street.

(i)    The Southeasterly side of Hilltop Road from Willow Lane westward for 250 feet.

In accordance with K.S.A. 8-2002, the Governing Body does hereby prohibit all parking on both sides, and along the entire length, of Commerce Drive.

(a)   For purposes of this parking restriction, the term “Truck” shall be defined as all motor vehicles or combination of vehicles which are included within those vehicles required by the Kansas Secretary of Transportation to be plated, licensed and tagged as a truck and which have a gross registered vehicle weight equal to or greater than 53,999 pounds.

(b)   The Governing Body hereby prohibits the parking of Trucks on any public streets, rights-of-way, and/or other public parking areas which adjoin private property that is zoned for residential use.

(c)   The above prohibition shall not apply to:

(1)   Emergency situations;

(2)   Governmental storage or operations; 

(3)   Trucks actively engaged in legitimate loading or unloading activities;

(4)   Trucks that are part of lawfully permitted construction or a service call actively underway on adjacent property; or

(5)   The Truck is making routine deliveries to adjacent property.
